1 Definitions

Data privacy is a complex topic. We have compiled some of the basic definitions for you to make it easier to understand this privacy policy.

Order processing” (abb. OP) in terms of Art. 28 of the General Data Protection Regulation (GDPR) is to be simply understood as a service where personal data is collected, processed and / or used on behalf and instruction of the controller by a service provider (processor according to GDPR). Before such an order can be issued to a service provider, we conclude a specific contract with the service provider and take other measures to protect your personal data.

Cookies” are small text files that are stored on your end device (e.g. computer or smartphone) and save certain settings and data to share with our system through your browser. A cookie usually contains the name of the visited website which the cookie files were sent from, information about the age of the cookie and an alphanumerical identification code. Cookies allow systems to identify the user’s device and instantly provide any possible presettings.

Third party is any natural or legal person or body, except the person concerned, the controller, the processor and the people who are authorised to process the personal data under the controller or processor’s direct responsibility, see Art. 4 No. 10 GDPR. It is therefore not a third party if personal data is being given to a service provider as part of order processing in accordance with Art. 28 GDPR. 

 

 

IP addresses are numerical sequences, which can be allocated to individual IT devices or a group. The IP is used to be able to assign data to the right recipient, similarly to postal addresses.

Personal data” is to be understood as any information relating to an identified or identifiable natural person, specifically the first and last name, date of birth, email address, home address, as well as bank and payment details and also health details, see Art. No. 1 GDPR.

Controller” according to Art. 4 no. 7 GDPR is any person or entity which solely or jointly determines the purposes and means of processing personal data (in this case the website operator).

Each time you access this website, data is automatically logged, which also applies to the calling up of files (log data). Here we collect and use the technically necessary data to make the website available to you. The technically necessary data transmitted to our web server by your browser includes, for example: Browser type/browser version, operating system used, referrer URL, pages accessed, IP address, date and time of the request.

We need this data to ensure the functionality of the website and to make your visit to this website as pleasant as possible. We reserve the right to analyse the logged data for the purpose of data security on a case-by-case basis. Google Tag Manager

The Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

 

Demographic parameters provided by Google Analytics

This website uses the “demographic characteristics” function of Google Analytics, to be able to display to the website visitor compatible ads within the Google advertising network. This allows reports to be created that contain information about the age, gender, and interests of the website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third-party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data”.

 

Archiving period

Formation of Target Groups with Customer Reconciliation

For the formation of target groups, we use, among other things, the Google Remarketing customer reconciliation feature. To achieve this, we transfer certain customer data (e.g., email addresses) from our customer lists to Google. If the respective customers are Google users and are logged into their Google accounts, matching advertising messages within the Google network (e.g., YouTube, Gmail or in a search engine) are displayed for them to view.

 

Google Conversion-Tracking

This website uses Google Conversion Tracking. The provider of this service is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

With the assistance of Google Conversion Tracking we are in a position to recognize whether the user has completed certain actions. For instance, we can analyze the how frequently which buttons on our website have been clicked and which products are reviewed or purchased with particular frequency. You can get in touch with us by using a form provided on the website. If you use the online form, we collect and store your personal data that you have entered into the input mask (e.g. name, postal code, city, telephone number, e-mail address). We use your data exclusively for the purpose of processing and answering your enquiry. Your data will not be passed on to third parties. Unless there are no other legal provisions and your request does not serve the preparation of a contract, your data will be deleted within a reasonable period after completion of processing by us.

4  Integration services and third-party content
 

4.1 General information

It is possible that within this online offer on the basis of our legitimate interests in terms of Art. 6 para. 1 lit. f DS-GVO (our legitimate interest is focused on the analysis and optimisation of our online offer) third party contents, such as videos from YouTube or graphics from other websites are incorporated. This always assumes that the provider of this content (subsequently referred to as “third-party provider”) uses the user’s IP address. As without the IP address, the content generally cannot be sent to the respective user’s browser. The IP address is therefore required to display this content. We make every effort to only use content whose providers only use the IP address to deliver the content. However, we do not have any influence over third-party providers storing the IP address, e.g. for statistical purposes. If we are aware of this, we inform the user.

 

4.2 Web analysis with matomo

On the basis of our legitimate interests as defined in Art. 6 para. 1 lit. f DS-GVO (our legitimate interest is focused on the analysis and optimisation of our online offer), we process your data (e.g. type of browser used including the browser version, operating system used, date and time of access, number of visits and duration of your visit to our website, your country of origin and the external links you have called up) for the purpose of analysing your reach.

For this purpose we use the software "Matomo" (www.matomo.org) in order to be able to statistically evaluate the accesses to the provided Internet offer. The Matomo software uses small text files which are stored on the computers accessing the provider's website (cookies) and thus enable the analysis of the specific use of our website

The data collected in this way will only be stored anonymously. A personal identification is not connected with it. To ensure this, the IP address is anonymised before it is stored. The information generated by the cookie about your use of this website will only be stored on our server and will not be passed on to third parties.

If you have objected to the use of cookies when starting this website, no web analysis of your visit will take place.

4.3 Use of Google DoubleClick

On the basis of our legitimate interests defined in Art. 6 para. 1 lit. f DS-GVO (our legitimate interest is focused on the analysis and optimisation of our online offer), we use the online marketing procedure Google "Doubleclick" of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland; "Google").

 

By means of this function, we can address you in a targeted manner with advertising by placing personalised, interest-related advertisements for you on other websites in the Google Display Network. Google uses cookies to analyse website usage, which forms the basis for creating interest-related advertisements. By calling up external servers, Google may, among other things, record and store your IP address. A processing of personal data outside the area of the European Union (EU) cannot be excluded. 4.5 Using the javascript library jQuery
 

We use the javascript library jQuery. On the basis of our legitimate interests as defined in Art. 6 para. 1 lit. f DS-GVO, in order to increase the loading speed of our website and thus provide you with a better user experience, we use Google's CDN (content delivery network) to load this library.

If you have already used jQuery on another Google CDN page, your browser will be able to access the cached copy and will not need to download it again. If your browser does not cache a copy or download the file from Google CDN for some other reason, data will be transferred from your browser to Google again. By calling up external servers of Google in the USA, it is possible that Google records and saves your IP address among other things.

5 Social media networks / platforms
 

We use a number of social networks and platforms to inform customers and interested parties, who are active in the respective networks, about our offers and to communicate with them. We use the social media networks / platforms exclusively within the framework of our presence on these pages.

The processing of personal data within the framework of the use of social media services also includes processing purposes for market research, advertising and the collection of statistical data. The social media providers can create user profiles (tracking) on the basis of usage behaviour and use these, among other things, to display interest-based advertising and provide the operator of a social media channel with statistical data for using the offer. To record user behaviour and to create and store user profiles, cookies of the social media service provider are usually set and stored on the user's devices. The processing of your personal user data and the data of the statistical evaluation of the use takes place on the basis of our legitimate interests (in accordance with Art. 6 para. 1 lit. f DS-GVO) in an effective information of the users and communication with the users. If you have given your consent, as a user of the respective social media service, to the aforementioned data processing, the legal basis for the processing is Art. 6 Para. 1 lit. a DS-GVO.

Further information on the scope of personal data processing by social media providers, the processing purposes, deletion periods, the legal basis of the processing as well as your rights and the possibility to make specific settings (opt-out) can be found in the data protection notices of the respective social media service providers listed below.

If you would like information about the processing of your personal data in connection with social media services or if you wish to assert your rights in this connection, we would like to point out that this is most effective if you address your request directly to the respective service provider. If you should assert your request for information or other rights against us, we will willingly forward your request to the service provider, since he has access to the corresponding user data and can take measures according to your user rights.

When using social media services, the processing of personal user data outside the European Union (EU) cannot be excluded. The processing of personal data outside the EU entails fundamental risks with regard to the enforcement of the rights concerned and keeping the general protection objectives of data protection. The providers of social media services used by us, regularly process personal data in the USA, i.e. outside the EU. As the operator of a social media site, we are responsible for data processing together with the respective platform operator.

We process personal data if and to the extent that this is necessary for the justification, execution or termination of the respective legal transaction (purchase, invoice processing and pre-contractual measures, such as preparing an offer). For this purpose, we collect and process the necessary personal data (title, first and last name, e-mail address, postal address, payment data, product-specific data, order history) required to fulfil the order and, if necessary, to prepare an offer.

The legal basis for the processing is Art. 6 Para. 1 lit. b DS-GVO; if you have given your consent, Art. 6 Para. 1 lit. a DS-GVO applies additionally.

If you have provided us with personal data when ordering a product, we will use this information (title, first and last name, e-mail address, telephone number if applicable) to inform you about similar attractive offers. 7 Forwarding your data, using services

We collect and use your data in compliance with statutory regulations and only for our own purposes. Data is not forward to third parties, unless there is a legal obligation to do so or you have consented to this or the forwarding is necessary to fulfil a contract between you and us

 

 

7.1 Forwarding your data for service processing

We only pass on your data to third parties if this is necessary for the fulfilment of our contractual obligations towards you. This includes passing on of your data to the shipping service provider (e.g. Deutsche Post) to deliver the orders placed or passing on the necessary payment data to the payment service provider to settle the payment. We only forward the required data for the respective task to the service provider involved. Any further use of your data by the service provider will not take place.

7.2 Use of service providers for service processing

As far as we access other service providers in order to facilitate our offer and possibly grant them necessary access to your data, we have of course concluded a contract for order processing (in short AV-contract)) in accordance with Art. 28 DS-GVO with our service providers for order processing (in short order processor). We also remain responsible for the protection of your data. The conclusion of the contract does not mean that the service providers used are so-called third parties.

 

8 Duration of data usage / retention

Your personal data will be deleted if this does not conflict with legal retention obligations and if you have asserted a claim for deletion, if the data is no longer required for the purpose for which it was stored or if the retention is forbidden for other legal reasons.

 

9 Place of use of data

Your data will generally be processed in Germany. In exceptional cases, information that you transmit to us may be stored on servers within the European Union (EU). Should we as the "responsible party" deviate from this or should your data be stored outside the European Union, we will inform you about this.

 

10 Data security / Secure data transfer

Please note that the transfer of data on the Internet (e.g. by email) may have security gaps and vulnerabilities. It is therefore not possible to offer full protection against access by third parties. We safeguard our IT systems (including the website(s)) using technical and organisational measures (abb. TOM) to prevent unwanted access, forwarding, entry, loss and distribution as well as destruction and alteration by unauthorised persons. 

Your personal data is transferred securely over the Internet using the Secure Socket Layer coding system (256 bit SSL encryption). 

 

11 User rights / Data protection officer

11.1 Right of withdrawal

You may revoke your consent to the processing of your personal data at any time and with effect for the future in accordance with Art. 7 (3) DS-GVO, without any costs for you that exceed the transmission costs in accordance with the basic prices.  

 

11.2 Right of access

Subject to the legal requirements of Art. 15 DS-GVO, you may of course request information at any time if we process your personal data. If we process personal data from you, you can also request information about the circumstances and structuring of the processing and more details about the data processed.

 

11.4 Right to deletion

Under the legal requirements of Art. 17 DS-GVO, you have the right to demand that we delete personal data concerning you immediately. The right to deletion does not exist, among other things, if the processing of personal data is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation which we are subjected to (e.g. statutory storage obligations) or for the assertion, exercise or defence of legal claims.

 

11.6 Duty of notification

According to Art. 19 DS-GVO, we are obliged to inform all recipients, to whom personal data has been disclosed, about amendments, deletions and restrictions of the processing of your personal data. Exceptions may exist, if this is impossible or involves disproportionate effort. If required we willingly inform you about these recipients.
 

11.7 Right to data portability
